Biography

HUANG Mingtao,Wuhan University Professor and doctoral supervisor of the School of Law,Juris Doctor. From 2002 to 2006, he was awarded the title of Wuhan University Bachelor of Engineering, from 2008 to 2013 Wuhan University Law School Obtained successively Master of Laws and a doctorate. From 2013 to 2015 in Renmin University of China. He went to the University of Wisconsin-Madison School of Law in 2011-2012 and 2014 Faculty of Law, The University of Hong Kong Access to exchange. Since 2015, he has been teaching at the Law School of Wuhan University, and from October 2018 to October 2019 Wuhan Hanyang District Bureau of Justice Deputy Director.

China's Legislature-Centered Constitutional Review System: Promises, Challenges and Prospects

Research question: China has a legislature-centred mode of constitutional review. Should there be a procedural arrangement that bridges the judiciary and Congress when constitutional challenges are raised in cases?

The current Chinese review process is unclear on how to handle specific cases and provide remedies for rights violations. There is also no clear procedure for courts to refer constitutional challenges to China’s national legislature, the NPCSC.

Scholars in China disagree on whether concrete reviews should be implemented. Mingtao Huang argues there should be a way to address the need for specific reviews of constitutionality in judicial cases and create connections between the judiciary and the legislature to work together on constitutional challenges.
